Procedure 2 - Form of Action
Rule 2 of the
Utah
Rules of Civil Procedure
states that there is only one form of action in Utah, to be known as a
"civil action." Utah's Rule 2 is identical in language to Rule 2
of the Federal Rules of Civil Procedure. Both of these rules are
in contrast to the old English Common Law, which included a number of
different forms of action, such as suits in equity, replevin,
ejectment, action of covenant, writ of right, and more. Under the
English Common Law, each different form of action could be subject to
different rules and procedures.

Although
the different forms of action survived in America for a time after the
United States gained its independence, they have been essentially
abolished in both federal and state courts. England has also
largely abandoned the different forms of action. Thus, Rule 2 of
the Utah Rules of Civil Procedure has little if any practical effect in
litigation today.

forms of action served in some ways to simply the litigation process,
